ThredX Inc., a Delaware corporation ("ThredX") has designed and developed ThredX iOS applications for mobile devices (the “Experimental Software”), and is running a soft launch (the "Soft Launch") to, among other things, allow a limited number of people to download the Experimental Software to provide feedback and comments to ThredX regarding use of such applications.

This Privacy Policy (“Privacy Policy”) describes the information that ThredX and its subsidiaries and affiliates (“we,” “our”, or “us”) collect from or about you when you visit our website (including, without limitation, mobile websites), use one of our apps, or interact with our Experimental Software through the Soft Launch, as well as how we use, disclose, and protect your information and the choices you can make about your information.

1. Consent

By accessing the Experimental Software, you expressly consent to the collection, use, disclosure, and storage of your information and other information received by us as a result of such use in accordance with this Privacy Policy and the Terms of Use and as permitted or required by applicable law. If you do not agree with the terms of this Privacy Policy or the Terms of Use, you should immediately stop using or accessing the Experimental Software.

Please note that by accessing the Experimental Software, you expressly consent to the transfer of your information outside of your home country, which may provide for different data protection rules than in your country. We may make use of third-party service providers, including service providers located outside of this country to store and process data, on our behalf. When acting on our behalf, such service providers are only authorized to collect, use, disclose, or store personal information as described in this Privacy Policy. However, the government, courts, law enforcement, security, or regulatory agencies of a particular country may be able to obtain access to or disclosure of personal data and information as permitted by the laws of that country. 2. Data We Collect from You

At ThredX, we strive to collect only the personal data that we need. The personal data ThredX collects depends on how you interact with ThredX. When you participate in the Soft Launch, we may collect a variety of information listed below.

When you sign up for an account (“Account”) on our Experimental Software, you provide us with information such as your name, email address, password, or you connect to the Experimental Software via a social networking site (“SNS”). We may also ask for information, such as your telephone number, gender identity, and date of birth (collectively “PII”), and other information from you in order to provide the Experimental Software.

When you create a profile and set up your virtual closet in the Experimental Software, you may provide photos including profile pictures and photos for your avatar and clothing items (“Profile Data”), which will be collected. You are not required to provide Profile Data, however, if you choose not to do so, in many cases we will not be able to provide you with our Experimental Software. When interacting with the Experimental software you may also decide to provide clothing details, schedule outfits to a calendar, or save outfits into boards (“Outfit Data”).

During the Soft Launch you will provide feedback, analysis, suggestions, and comments to ThredX (including, but not limited to, bug reports and test results) (collectively, “Feedback”). Such Feedback may include personally identifiable information, including, without limitation, your account name, information regarding your contacts, calendar events, and email correspondence. By participating in the Soft Launch, you acknowledge and agree that you have obtained the necessary rights and consents to provide such information to ThredX and that ThredX may use them for ThredX’s diagnostic purposes and to improve the Experimental Software and ThredX’s products and services.

If you contact us via email or the help center for assistance, we will collect contact information, as well as any other content included in the message in order to send you a reply and/or address your concerns. For research and development purposes, we may use datasets such as those that contain images or other data that could be associated with an identifiable person. When acquiring such datasets, we do so in accordance with applicable law, including law in the jurisdiction in which the dataset is hosted. When using such datasets for research and development, we do not attempt to reidentify individuals who may appear therein.

3. Data We May Collect And/Or Receive From Third Parties

ThredX may receive personal data about you from other individuals, from businesses or third parties acting at your direction, from our partners who work with us to provide our products and services, and from other lawful sources.

We may receive information about you from third parties including third party SNS. You should always review, and if necessary, adjust your privacy settings on third party websites and services before linking or connecting them to the Experimental Software. You may also unlink your third party account from the Experimental Software by adjusting your settings on the third party service. We also may collect information about you from third party business partners, publicly available sources, and our subsidiaries and affiliates.

We may directly collect information, or we or our third party business partners may use analytics tools to help us measure traffic and usage trends for the Experimental Software (“Analytics Information”). We may receive log information relating to your device and your use of our Experimental Software. When you use the Experimental Software, our servers automatically record certain log file information (“Server Logs”). These Server Logs may include anonymous information such as your web request, Internet Protocol (IP) address, operating system, browser type, referring/exit pages and URLs, number of clicks and how you interact with links on the Experimental Software, domain names, landing pages, pages viewed, and other such information. The information contained in Server Logs is used to monitor, assess, manage, diagnose problems with, improve, and otherwise administer the Experimental Software.

When you access the Experimental Software by or through a mobile device (including but not limited to iPhones or iPads), we and/or our third party business partners may access, assign, collect, monitor and/or remotely store one or more unique device-specific identifiers, such as a universally unique identifier (UUID) (“Unique Identifiers”). Unique Identifiers are small data files or similar data structures stored on and/or associated with your mobile device, which uniquely identify your mobile device. A Unique Identifier may be data stored in connection with the device hardware, data stored in connection with the device's operating system or other software, or data sent to the device by us. A Unique Identifier may convey information to us about how you browse and use the Experimental Software. A Unique Identifier may also be used to help you log in faster and enhance your navigation through the Experimental Software.

When you access the Experimental Software by or through a mobile device, we may access, collect, monitor and/or remotely store location data, which may include GPS coordinates (e.g. latitude and/or longitude) or similar information regarding the location of your mobile device (“Location Data”). Location Data may convey to us information about how you browse and use the Experimental Software. Location Data may be used to personalize and customize your experience when using the Experimental Software, facilitate the functionality of certain features within the Experimental Software, and to improve the Experimental Software. Some features of the Experimental Software, particularly location-based services, may not function properly if use or availability of Location Data is impaired or disabled. iOS devices allow you to turn off location services.

We use the information we collect or receive to communicate directly with you. We may send you electronic messages containing Experimental Software-related notices (e.g., account verification, purchase and billing confirmations and reminders, feature notifications, technical and security notices). We may also send you electronic messages containing product and/or service offerings, promotions, invitations, and special offers. You can also stop receiving electronic messages (other than Experimental Software-related notices) from us by clicking on the "unsubscribe link" provided in such communications or by changing your account preferences or settings.

4. Use of Data We Collect

ThredX uses data to power our services, to process your transactions, to communicate with you, and to comply with law. We may also use personal data for other purposes with your consent.

ThredX uses your data only when we have a valid legal basis to do so. Depending on the circumstance, ThredX may rely on your consent or the fact that the processing is necessary to fulfill a contract with you, protect your vital interests or those of other persons, or to comply with law. We may also process your personal data where we believe it is in our or others’ legitimate interests, taking into consideration your interests, rights, and expectations. ThredX collects data necessary to power our Experimental Software, which may include personal data collected to improve our overall offerings, for internal purposes such as auditing or data analysis, or for troubleshooting. For example, if you would like to add a clothing item to your closet, we must collect and process the photo to model it for your avatar.

To respond to communications, reach out to you about your transactions or account, market our products and services, provide other relevant information, or request information or feedback. From time to time, we may use your personal data to send important notices, such as communications about purchases and changes to our terms, conditions, and policies.

If you ever choose to personalize your experience, ThredX will use information that we collect so that we can offer you those personalized services or communications. We may also use personal information to comply with applicable law - for example, to satisfy tax or reporting obligations, or to comply with a lawful governmental request.

ThredX retains personal data only for so long as necessary to fulfill the purposes for which it was collected, including as described in this Privacy Policy or in our service-specific privacy notices, or as required by law. We will retain your personal data for the period necessary to fulfill the purposes outlined in this Privacy Policy and our service-specific privacy summaries. When assessing retention periods, we first carefully examine whether it is necessary to retain the personal data collected and, if retention is required, work to retain the personal data for the shortest possible period permissible under law.

For research and development purposes, we may use datasets such as those that contain images, voices, or other data that could be associated with an identifiable person. When acquiring such datasets, we do so in accordance with applicable law, including law in the jurisdiction in which the dataset is hosted. 5. Who We May Share Your Data With

We may share personal data with ThredX affiliated companies, service providers who act on our behalf, our partners, developers, and publishers, or others at your direction.

ThredX may engage third parties to act as our service providers and perform certain tasks on our behalf, such as processing or storing data, including but not limited to Profile Data and Outfit Data, in connection with your use of our services and delivering products to customers. ThredX service providers are obligated to handle personal data consistent with this Privacy Policy and according to our instructions. They cannot use the personal data we share for their own purposes and must delete or return the personal data once they've fulfilled our request.

ThredX may share personal data with others at your direction or with your consent, such as when we share information with your carrier to activate your account. We may also disclose information about you if we determine that for purposes of national security, law enforcement, or other issues of public importance, disclosure is necessary or appropriate. We may also disclose information about you where there is a lawful basis for doing so, if we determine that disclosure is reasonably necessary to enforce our terms and conditions or to protect our operations or users, or in the event of a reorganization, merger, or sale.

We may also share your information with any subsidiary or affiliate of ours for purposes consistent with this Privacy Policy. Any subsidiary or affiliate of ours will be required to maintain that information in accordance with this Privacy Policy. We may also aggregate or otherwise strip data of all personally identifying characteristics (such as your name and email address) and may share that aggregated, anonymized data with third parties.

6. Who You May Choose to Share Your Data With

The safety and security of your information also depends on you. We urge you to take precautionary measures in maintaining the integrity of your data. Where we have given you (or where you have chosen) a password for access to certain parts of our Experimental Software, you are responsible for keeping this password confidential. Please be responsible in making sure no one can see or has access to your personal account and log-in/password information. Please remember that use of the Experimental Software is at your own risk and ThredX cannot and does not guarantee the security of information sent to, or received by it. We are not responsible for circumvention of any privacy settings or security measures contained on the If you use our Experimental Software through your employer’s computer network or through an internet café, library or other potentially non-secure internet connection, use is at your own risk. It is your responsibility to check beforehand on your employer’s or such other site’s privacy and security policy with respect to Internet use. ThredX has no responsibility for any data transmitted to and from your device and/or computer.

We are not responsible for your handling, sharing, re-sharing and/or distribution of your password or other data. Moreover, if you forward PII or any other data electronically to another person on or off the Experimental Software, we are not responsible for any harm or other consequences from third party use or re-sharing of your information.

7. How We Protect Your Data

We care about the security of your information, and take physical, technological and administrative measures to protect the information you submit via the Experimental Software against loss, theft, and unauthorized access, use, disclosure or modification. However, we cannot ensure or warrant the security of any information you transmit to us or guarantee that information on the Experimental Software may not be accessed, disclosed, altered or destroyed. Electronic communications sent to or from the Experimental Software may not be secure. You should use caution whenever submitting information online and take special care in deciding what information you send to us via email.

8. Your Choices About Your Data

You may update your account information and electronic message preferences at any time by logging in to your account and changing your profile settings or by contacting us at info@thredx.co. You can also stop receiving electronic messages (other than Experimental Software-related notices) from us by clicking on the "unsubscribe link" provided in such communications.

If you have any questions or concerns, or if you simply want to know whether we have any of your PII on file, you may contact us at info@thredx.co. Except as set out in applicable privacy laws, we can tell you whether we hold PII about you. We will allow you access to your PII. We will use reasonable efforts to tell you the source of the information and give an account of the use that has been made or is being made of the information and the third parties to whom it has been disclosed. If you are not satisfied with the response after making a request, you may have recourse to additional remedies under applicable privacy laws.

Please refer to your device’s or browser's technical information for instructions on how to delete and disable tracking/recording tools. Depending on the type of device you are using to access the Experimental Software, it may not be possible to delete or disable tracking mechanisms on the device. 9. Children's Privacy

The Experimental Software is not intended for individuals under the age of 18. We do not knowingly collect personal information from individuals under age 18. If you are under the age of 18, please do not use or submit any personal information through the Experimental Software. If we learn we have collected or received personal information from a child without verification of parental consent, we will delete that information. If you have reason to believe that we may have accidentally received personal information from an individual under age 18, please contact us immediately at info@thredx.co.

10. California Residents

Pursuant to California Civil Code Section 1798.83, residents of the State of California have the right to request from companies conducting business in California certain information regarding ThredX’s disclosure within the immediately preceding calendar year of that California resident’s personal information to third parties (and in some cases affiliates) for their direct marketing purposes. Alternatively, the law provides that a company may comply, as ThredX does, by disclosing in its privacy policy that it provides consumers choice (opt-out or opt-in) regarding sharing personal information with third parties and affiliates for those third parties’ and affiliates’ direct marketing purposes, and information on how to exercise that choice.

11. Changes To Our Privacy Policy

We may update or modify this Privacy Policy at any time and from time to time without prior notice. Please review this Privacy Policy periodically, and especially before you provide any information. This Privacy Policy was made effective on the date indicated above. The most current version of this Privacy Policy will govern ThredX’s processing of your information and data and will always be at thredx.co/privacy as well as on the Experimental Software under “Support” in your user settings.
